Court discharged and acquits Chief Victor Osita Uwajeh

An Abuja High Court on Thursday discharged and acquitted  Mr Victor Uwajah on a 6-court charge against him by the EFCC on forgery and for parading himself as a staff of the EFCC with the intent to defraud unsuspecting members of the public.

Justice Ugochukwu Ogakwu , in his judgement told the court that, corruption in the course of this case  made him understood that, anyone fighting corruption, corruption will fight back through an individual or institution as this case had rightly showed.

Ogakwu , in discharging the accused person added that,the entire case for the prosecution was based on suspicion  as no direct direct creditable evidence  was lead against the accused person by the prosecution.


" I therefore find the allegation of forgery, extortion and impersonation in merit and the allegations of false document as not haven been prove beyond reasonable doubt by the prosecution.

"I found out that, through out the prosecution of this matter there was no petition written against the accused by any individual or group of persons he has investigated.  He said"


The court also express surprised at the prosecutor's belated attempt to withdraw count 5-6 relating to charge of  extortion of Cecila Ibru on the date of adoption of final written address.

Ogakwu , added that, the  withdrawal  should have been done at the earlier stage of matter before the prosecution closed its case.

It's recalls that, Uwajeh on or about the 28th of October 2009 in the Abuja division of the high court of the FederUwajeh was arraigned on a four count charge of forgery and for parading himself as a staff of the EFCC with the intent to defraud unsuspecting members of the public, an offence contrary to section 363 of the Penal Code Act Cap 532 Laws of the Federation of Nigeria, 1990, and punishable under Section 364 of the penal code Act.

 Uwajeh on the or about the 28th of October 2009 in the Abuja division of the high court of the Federal Capital Territory fraudulently used as genuine a forge document captioned “RE: CERTIFIED TRUE COPIES OF DEEDS ATTACHED” dated 28th October 2009 knowing same to be forged and thereby committed an offence contrary to section 366 of the PENAL CODE ACT CAP 532 LAWS OF THE FEDERATION OF NIGERIA (ABUJA) 1990 and punishable under section 364 of the same Penal Code Act.

 Uwajeh between the3rd of November 2008 and the 13th of January 2010 in the Abuja judicial division of the high court of the Federal Capital Territory made false complimentary cards of the Economic and Financial Crimes Commission with the intent to commit fraud and thereby committed an offence contrary to section 363 of the PENAL CODE ACT CAP 532 LAWS OF THE FEDERATION OF NIGERIA (ABUJA) 1990 and punishable under Section 364 of the same Penal Code Act

 Uwajeh between 3rd of November 2008 and 13th of January 2010 in the Abuja judicial division of the high court of the Federal Capital Territory fraudulently used as genuine forged complimentary cards of the Economic and Financial Crimes Commission knowing same to be forged and thereby committed an offence contrary to Section 364 of the Penal Code Act.
